School districts in Pennsylvania are responsible for ensuring that all regulations related to the provision of an appropriate program for students with disabilities are implemented. The Federal and PA Special Education Laws and Regulations Side-by-Side document was developed to include all federal and state requirements in one document.On one column of this document you may find regulations adopted by the State Board of Education (School Districts May 1, 2004) and the Department of Education (Charter Schools June 9, 2001). On the other column of this document you may find the federal regulations (March 12, 1999). These were adopted by reference by the State Board of Education or the Department of Education which has the effect of governing the provision of special education delivered to students with disabilities attending public schools or charter schools, and the provision of special education delivered to young children through the preschool programs required under Act 212 of 1990.
